1. About these terms

Dead Shut products are sold by Lodestar International Limited, which operates the website at deadshut.com. In these terms, “Dead Shut”, “Lodestar International Limited”, “we”, “us” and “our” refer to that seller. “You” means a visitor to the website or a customer purchasing from us.

By using the website or placing an order, you agree to these terms. If you place an order for an organisation, you confirm that you have authority to bind that organisation.

2. Website use

You may use this website for lawful personal or business purchasing purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape it in a way that disrupts the service, or use its content in a misleading or unlawful way.

We may change, suspend or withdraw any part of the website when reasonably necessary, including for maintenance, security or operational reasons.

3. Product information and suitability

We take reasonable care to describe and display our products accurately. Colours, finishes and minor manufacturing details may vary from images. Measurements, compatibility information and installation times are guides unless expressly stated otherwise.

Dead Shut is a physical security product designed to add a hold-down point between a compatible roller door and suitable concrete. It is one part of a layered security plan. No security product can guarantee that forced entry, theft, damage or weather-related loss will never occur.

You are responsible for checking that the product is suitable for your door, substrate, intended use and local conditions. If you are unsure, send us a clear fit-check photo before ordering or obtain advice from a suitably qualified installer or engineer.

4. Orders

An order is an offer from you to purchase the products shown in your checkout. An automated confirmation means we received your order; it does not necessarily mean we accepted it. We accept an order when we issue a dispatch confirmation or otherwise confirm acceptance.

We may decline or cancel an order before dispatch if a product is unavailable, payment is not authorised, delivery details cannot be verified, quantity limits apply, or information on the website contained a genuine error. If we cancel after taking payment, we will refund the affected amount using the original payment method.

Please check your contact, delivery and order details before submitting payment and tell us promptly if anything is wrong.

5. Pricing and payment

Unless stated otherwise, prices are in Australian dollars and include GST where applicable. Delivery charges, discounts and the final order total will be shown before you confirm payment.

Payments are processed by Stripe or another payment provider shown at checkout. Their terms and privacy practices may also apply. We do not intentionally collect or store your complete card number.

You authorise us and our payment provider to charge the amount shown at checkout. You must use a payment method you are authorised to use.

6. Shipping and delivery

Available delivery areas, charges and estimated timeframes are shown on the website or at checkout. Delivery dates are estimates unless we expressly agree to a guaranteed date.

You must provide a complete and accurate delivery address and a safe place to receive the parcel. If an order is returned because the address was incorrect or delivery could not reasonably be completed, we may charge the reasonable cost of redelivery.

Ownership and risk pass to you when the order is delivered to the nominated address, except where applicable law requires otherwise. Contact us promptly if a parcel arrives damaged, is incomplete or appears to be missing.

7. Installation and safe use

Read and follow the supplied instructions, warnings and fixing requirements. Installation requires sound concrete and appropriate tools. Do not install into pavers, asphalt, damaged concrete or another unsuitable base using the supplied concrete fixings.

Check for concealed services before drilling. Use appropriate protective equipment. If you are not competent or confident to complete the work safely, use a suitably qualified installer.

Always unlock and fully disengage Dead Shut before operating a manual or automatic door. Do not activate a door motor while the anchor is engaged. Inspect the product, fixings, door and padlock periodically and stop using any component that is loose, damaged, heavily corroded or otherwise unsafe.

8. Change of mind

We do not offer refunds, returns or exchanges where you simply change your mind, order the wrong product or decide that you no longer want the product.

Please use our pre-purchase fit-check service if you are unsure whether Dead Shut is suitable for your door. This change-of-mind policy does not limit any right or remedy you have where a product fails to comply with a consumer guarantee under the Australian Consumer Law.

9. Faults and consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Products must be of acceptable quality, fit for any purpose we agreed to, and match their description.

If you believe a product has a problem, contact us with your order details, a description and, where practical, photographs. We are responsible for assessing and providing any remedy required by law. Depending on the circumstances, this may include a repair, replacement, refund or compensation for reasonably foreseeable loss.

If the product is confirmed to have a problem covered by the consumer guarantees, we will reimburse reasonable return costs where required. We will not direct you to the manufacturer instead of dealing with a valid claim.

10. Responsibility and liability

Nothing in these terms limits liability or remedies that cannot legally be limited. To the maximum extent permitted by law, we are not responsible for loss caused by incorrect installation, use with an unsuitable door or substrate, failure to unlock before operating the door, unauthorised modification, failure to maintain the product, or use contrary to supplied instructions.

Where the law permits, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the order was accepted. This clause does not affect rights available under the Australian Consumer Law.

11. Intellectual property

The Dead Shut name, website copy, graphics, photography, product documentation and other website content are owned by or licensed to us and are protected by applicable intellectual property laws. You may view and print reasonable copies for personal use, product evaluation or record-keeping, but may not reproduce or commercially exploit the content without permission.

12. Third-party services

The website may link to or use third-party services, including Stripe, Netlify, delivery providers and email services. We are not responsible for third-party websites we do not control. Their own terms and privacy policies may apply when you use them.

13. Changes and governing law

We may update these terms from time to time by publishing a revised version and changing the “last updated” date. The terms in effect when we accept your order will apply to that order unless a change is required by law.

These terms are governed by the laws applicable in Australia. You and we submit to the courts and tribunals that have jurisdiction, without limiting any right you may have to bring a claim in another competent forum.
